The agreement between you and the estate — how accounts, purchases, and the products work. Written to be read, not endured.

01Who we are
These Terms of Service (the "Terms") govern your access to and use of the digital products, storefronts, and reading experiences operated by Kwacha Kulture B.V. ("Kwacha Kulture", "we", "us"), including Savanna, Lwazi, and the Griot reading library. By creating an account, making a purchase, or otherwise using the services, you agree to these Terms.
If you do not agree, please do not use the services. If you are using them on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.
02Accounts
Some features require an account. You are responsible for keeping your credentials confidential and for all activity under your account. Tell us promptly at the address below if you suspect unauthorised use.
You must be old enough to form a binding contract in your jurisdiction. Content in the academy may carry its own age guidance.
03Purchases, entitlements & licence
Paid products may be sold as one-time purchases (for example, a volume in the Griot library) or as recurring subscriptions. Prices, taxes, and what each plan includes are shown at the point of purchase and may change over time; changes never apply retroactively to a purchase you have already made.
When you buy access to a work or a plan, we grant you a personal, non-exclusive, non-transferable licence to read, stream, and enjoy that content for your own use. You do not acquire ownership of the underlying work, and you may not copy, resell, redistribute, publicly perform, or create derivative works from it except as the law expressly permits.
04Subscriptions & renewals
Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from your account; cancellation stops the next renewal and you keep access until the end of the period already paid for.
05Intellectual property
The stories, curriculum, designs, artwork, software, trademarks, and other materials across the estate are owned by Kwacha Kulture or its licensors and are protected by intellectual-property law. The African cultural knowledge presented in the academy is offered in a spirit of restoration and respect; nothing here claims ownership of a living culture, its language, or its heritage.
06Acceptable use
So the services stay usable and dignified for everyone, you agree not to:
- circumvent paywalls, entitlements, or usage limits, or share access you were not granted;
- scrape, mass-download, or attempt to extract source content beyond ordinary personal reading;
- probe, disrupt, or attempt to gain unauthorised access to the services or their infrastructure;
- upload unlawful, infringing, or harmful material, or misrepresent your identity.
07Disclaimers & liability
The services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
08Changes to these Terms
We may update these Terms as the products evolve. When we make material changes we will update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept the revised Terms.
09Governing law & contact
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, and subject to any mandatory consumer protections of your country of residence.
